The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD's rulemaking and control measure implementation schedule. Scheduling changes that occurred since last month's forecast are summarized. Progress in 2004 Significant progress was made in 2004 in the development and adoption of rules and rule amendments. Thirty five (35) rules were amended and five (5) new rules were adopted. The AQMP called for the adoption of seven control measures in 2004 and for emission reductions of 2 tons/day of VOC, 3 tons/day of NOx, 1.7 ton/day of PM10 and 2.1 tons/day of SOx. Two additional control measures, WST-01 (Dairy Operations) and FUG-05(II) (VOC Fugitive Emissions), originally slated for adoption in 2003, were carried over to 2004. With the rulemaking activity in 2004, the AQMD achieved 3.4 tons/day VOC reductions, exceeding its AQMP VOC target. With the exception of control measure PRC-07(P1), all of the VOC control measures scheduled for 2004 were adopted. As part of its efforts to implement PRC-07, staff explored the feasibility of further reducing emissions from the foam blowing operations (Rule 1175) and can and coil coating operations (Rule 1125) without much success. The findings of the feasibility studies will be published in February 2005 as an attachment to the rule forecast report. The surplus VOC reductions achieved by the other VOC measures adopted in 2004 will be used to offset the 1 ton/day of VOC reduction target of PRC-07. Relative to the emission targets for PM10 and NOx, the 2004 rulemaking achieved 1 ton/day of PM10 emission reductions only because two of the rulemaking efforts (Rule 1157 and RECLAIM) implementing control measures CMB-08 and CMB-10 had to be delayed to allow further public input and staff analysis. These two proposals are designed to far exceed the NOx and PM10 emission reduction targets for 2004 and the public hearing for both proposals is set for January 2005. The achieved PM10 reductions in 2004 from Rules 403/1186 (BCM0-07) were used to substitute for the reduction commitment of control measure PRC-03 (restaurant operations), which was found infeasible to implement. The infeasibility finding was made by the Governing Board in December 2004. With respect to the SOx emission reduction target for 2004, the AQMP calls for the implementation of control measure CMB-07 to further reduce emissions from refinery flares, currently subject to emissions monitoring and reporting requirements of Rule 1118. Although emissions reporting from refineries indicates declining emissions from flaring during the last several years, commensurate to the SOx emission reduction targets of the AQMP, a recent status report to the Governing Board presented by staff in August 2004 pointed to the need for improved data collection and reporting, and the feasibility for further reductions. As directed by the Governing Board, staff intends to amend Rule 1118 in 2005 to address recommendations identified by the report. An Addendum to the 2000 draft Air Toxics Control Plan (ATCP) was approved by the Board in April 2004. The document noted significant progress made in reducing air toxics in the last several years. The addendum provided a status of the various mobile and stationary source strategies in the original ATCP, revised projections based on what has been accomplished, provided new inventory information to reflect updates from the 2003 AQMP, and summarized measures identified in the Cumulative Impacts Reduction Strategy and the 2003 AQMP. Rule 1470, which covers diesel-fueled internal combustion engines, was also adopted in 2004. This rule implements a state Air Toxic Control Measure and added more stringent requirements for engines located on or near school grounds. Rules to be Rescheduled/Removed and Added

Below is a list of all rulemaking activity scheduled for the year 2005. The
last three columns refer to the type of rule adoption or amendment: AQMP refers
to the adoption and implementation of AQMP control measures (Attachment A);
Toxics refers to the adoption and implementation of programmatic as well as
source-specific toxic-related rules (Attachment B); and Other refers to
administrative rules or changes to an existing rule to clarify or improve rule
enforceability, SIP corrections, or implementing state or federal regulations
(Attachment C). A more detailed description of the proposed rule adoption or
amendment is located after this calendar under the type of rule adoption or
amendment (i.e. AQMP, Toxics, and Other) Upcoming Public Workshops are located
at the end of the report (Attachment D).
