Set Public Hearings May 6, 2005 to Consider Amendments and/or Adoption to AQMD Rules and Regulations to:

Amend Rule 403 Fugitive Dust. Amendments to Rule 403 are proposed to incorporate SB 700 provisions to require Best Available Control Measures for fugitive dust sources at confined animal facilities no later than January 1, 2006. Additionally, Proposed Amended Rule 403 will address an implementation issue related to 2004 amendments affecting weed abatement activities. (Review: Stationary Source Committee, April 22, 2005)

Amend Rule 461 Gasoline Transfer and Dispensing. Proposed Amended Rule 461 implements California Health and Safety Code (H&S Code) Section 40724 to require best available retrofit control technology for agricultural sources by phasing out the exemptions for agricultural operations. Staff recommends the Board make the required findings under H&S Code Section 42301.6 to require permits for all equipment subject to Rule 461 at agricultural sources, regardless of the source size, to ensure enforceability of the rule. Additional amendments are proposed to enhance recordkeeping and reporting, to require personnel training and AQMD inspection prior to backfilling and observation of all 30-day performance tests. An exemption from the Phase II requirements is proposed for fueling Tournament of Roses Parade floats. (Review: Stationary Source Committee, March 25, 2005)

Amend Rule 1162 Polyester Resin Operations. Proposed Amended Rule 1162 removes the requirement of applying gel coats solely with nonatomizing spray application techniques, establishes a list of acceptable low emitting spray application techniques for gel coat, and clarifies the use of hand-held spray equipment for gel coat touch-up and repair. Amend Regulation III - Fees. Staff is proposing an adjustment to fees to fund the AQMD FY 2005-06 Budget. (Review: Stationary Source Committee, April 22, 2005; Administrative Committee, May 13, 2005)

Amend Rule 1110.2 Emissions from Gaseous and Liquid-Fueled Engines and Rescind Rule 1110.1 Emissions from Stationary Internal Combustion Engines. SB 700 eliminates the exemption from the permit system for agricultural operations and requires air districts to implement BARCT for agricultural engines. Amendments are proposed to Rule 1110.2 in order to comply with SB 700. Proposed amendments include removing the exemption for stationary non-emergency, agricultural internal combustion engines, except for orchard wind machines, and requiring them to comply on a tiered compliance schedule. Proposed Amended
Rule 1110.2 would supercede requirements provided in
Rule 1110.1. As such, staff recommends that Rule 1110.1 be rescinded. (Review: Stationary Source Committee, April 22, 2005) |
