The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD's rulemaking and control measure implementation schedule. Scheduling changes that occurred since last month's forecast are summarized.

Rule 219 is being moved to February 2006 from December 2005 to allow additional time for public comment.

Fugitive Dust |
|
Rule 403 is being added to the schedule for hearing in February of 2006. The proposed amendments are to address implementation issues associated with existing exemption provisions related to weed abatement activities ordered for fire hazard reduction and to all sources under high-wind conditions.

Possible amendments to Rules 1193 and 1195 are no longer necessary since CARB did not take action to adopt similar rules. However CARB did take action to amend the state Urban Transit Rule. As such, potential amendments to Rule 1192 may be needed; for this reason, it will remain scheduled for hearing in the 1st Quarter of 2006. Rules 1193 and 1195 are being moved to an undetermined date in 2006 in the event future courts action requires amendments.

Proposed amendments to Rule 1195 would reinstate exemption for alternative fuel refueling stations within five miles, to allow for rule compliance flexibility. It is being added to the calendar for hearing in February of 2006.

Proposed Rules 3501 and 3502 are being moved from December to February 2006 to allow additional time to work with stakeholders and to conduct further data analysis.

Below is a list of all rulemaking activity scheduled for the year 2005. The
last three columns refer to the type of rule adoption or amendment: AQMP refers
to the adoption and implementation of AQMP control measures (Attachment A);
Toxics refers to the adoption and implementation of programmatic as well as
source-specific toxic-related rules (Attachment B); and Other refers to
administrative rules or changes to an existing rule to clarify or improve rule
enforceability, SIP corrections, or implementing state or federal regulations
(Attachment C). A more detailed description of the proposed rule adoption or
amendment is located after this calendar under the type of rule adoption or
amendment (i.e. AQMP, Toxics, and Other).
*An asterisk indicates that the rulemaking is a potentially significant
hearing.
+This proposed rule will reduce criteria air contaminants and assist toward
attainment of ambient air quality standards.
