SYNPOSIS:

The Stationary Source Committee met Friday, January 27, 2006. Following is a summary of that meeting. The next meeting will be February 24, at 10:30 a.m., in Conference Room CC8.

Attendance

The meeting began at 10:35 a.m. Present were Jane Carney, Acting Chair, and Gary Ovitt. Absent were Ronald Loveridge and Dennis Yates.

INFORMATIONAL ITEMS

  1. Rule 1146 – Emissions of Oxides of Nitrogen from Large Water Heaters and Small  Boilers

Joe Cassmassi, Planning and Rules Manager, presented a status report on the proposed amendments to Rule 1146.2. The proposal will lower the NOx emissions rates for new equipment and capture emissions reductions forgone due to a previous extension in the rule implementation compliance date. The proposal included new reporting and maintenance requirements and addressed selected issues brought by the regulated community including the applicability of alternant compliance plans. The Rule is planned to go to the AQMD Governing Board hearing for adoption in April 2006.

One comment was received after the presentation. Mr. Bill LaMarr of Small Business Alliance, asked whether the rule would require retrofitting a newly installed boiler. Staff responded that the proposed modified rule addresses new equipment and that the existing equipment would not be subjected to the proposed amended rule provisions until an operator needed to replace the boiler.

  1. Proposed Amendments to Rule 1309.1 – Priority Reserve and Rule 1302 – Definitions

Larry Bowen, Planning and Rules Manager, presented this status report on amendments to Rules 1309.1 and 1302. Prior to being taken to the AQMD Governing Board for adoption, these proposed rules will come back for further review by the Stationary Source Committee. The purpose of the amendments is to allow limited access to the Priority Reserve for both in-Basin and out of Basin electrical generating facilities and other energy projects of regional significance provided they pay a mitigation fee for the credits they receive. In addition, it is being clarified that publicly owned biosolids processing facilities are an essential public service. There are issues to resolve including the cost of the mitigation fees be-fore the proposal is set for public hearing. Greg Adams, Los Angeles County Sanitation District, made a comment that staff’s proposed amendments just demonstrate the lack of offset availability and further the AQMD’s need to address this issue before all industries request to access the priority reserve.

  1. Rule 223 – Facility Permit – Agricultural Facilities

Larry Bowen, Planning and Rules Manager, presented this item. Staff is developing a new Rule 223 to implement the permitting and other requirements for large confined animal facilities required by the enactment of State Senate Bill 700. The proposed rule is expected to go to the AQMD Governing Board hearing for adoption in May 2006.
