Rule and Control Measure Forecast

This report highlights AQMD rulemaking activity and public workshops potentially scheduled for the year 2006.

The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD’s rulemaking and control measure implementation schedule. Scheduling changes that occurred since last month’s forecast are summarized.

Progress in 2005

Significant progress was made in 2005 in the development and adoption of rules and rule amendments. Twenty (20) rules were amended and six (6) new rules were adopted.

The AQMP called for the adoption of three control measures in 2005 and for emission reductions of 2.0 tons per day of VOC and 2.1 tons per day of NOx, both in 2010 based on the planning inventory. It also began the implementation of long term commitments (i.e., 4 tons per day of VOC reductions).

With the SIP rulemaking activity in 2005, the AQMD achieved 5.7 tons per day of VOC reductions by 2010, including 4.2 tons per day VOC reductions from Rule 1151 - Auto Body Coatings, which substituted for PRC-07 - Industrial Processes, and 1.5 tons per day VOC from Rule 1107 - Metal Coatings.

Relative to the emission targets for PM10, the 2005 rulemaking achieved 1.0 ton per day of PM10 reductions from Rule 1156 - Cement Facilities, and Rule 1157 - Aggregate Facilities, which implemented control measure CMB-08. These reductions were scheduled for 2004. Overall, PM10 reductions achieved by the 2005 rulemaking exceed the AQMP target for the year 2010.

CMB-10 scheduled for 2004 adoption, was implemented by amendments to RECLAIM, which will reduce 7.1 tons per day of NOx by 2010, exceeding the AQMP commitment of 3 tons per day of NOx reductions. MSC-05 - Truck Stop Electrification, was fulfilled by CARB’s heavy duty truck idling regulations. Overall, cumulative NOx reductions exceed AQMP targets.

With respect to the SOx emission reductions, Rule 1118 - Refinery Flares, was adopted to implement control measure CMB-07 scheduled for 2004 adoption. This rule resulted in 3.7 tons per day SOx in 2010, exceeding the 2.1 ton per day AQMP commitment.

Rule 403 - Fugitive Dust, Rule 461 - Gasoline Transfer and Dispensing, and Rule 1110.2 - Gaseous and Liquid Fueled Internal Combustion Engines, were amended in 2005 to implement SB700. Rule 403 was amended to include BACM for animal facilities and Rules 461 and 1110.2 were amended for BARCT measures for agricultural operations.

A technical assessment for Rule 1168 - Adhesives, and a rule amendment for Rule 1162 - Polyester Resin, resulted in emission reductions foregone of 1.8 tons per day VOC and 0.9 tons per day VOC, respectively. Another technical assessment and Rule 1146.2 – Small Boilers and Heaters, resulted in 0.4 tons per day NOx delay.

In March, the AQMD submitted a CO Redesignation Request and a Maintenance Plan because the Basin is meeting the standard for CO.

No specific control measures were identified for adoption in 2006. However, the long-term commitment for VOC includes a 10 ton per day reduction in 2006.

Significant progress was made in reducing air toxics in 2005. Three new toxics rules were adopted in 2005. Rule 1469.1 was adopted to reduce hexavalent chromium emissions from wet spraying operations and Rule 1401.1 was adopted to implement more stringent health risk requirements for new or relocated facilities emitting toxic air contaminants that site near existing schools. In addition, Rule 3503 was adopted to require freight railroads to conduct emissions inventories and health risk assessments to estimate the health risk from railyard activities. Rule 3503 also includes public notification requirements.

In addition, Rule 1470 - Diesel Internal Combustion Engines, was amended to incorporate changes to the state Air Toxic Control Measure and Rule 1401 was amended to update the list of toxic air contaminants.

Proposed Rule 120 is being scheduled for an undetermined date to address new or modified sources emitting pollutants meeting the federal/state air quality standards or regulated under the federal Clean Air Act but for which no applicable NAAQS exists.

Intermodal Equipment

Proposed Rule 1198 is being scheduled for an undetermined date to augment CARB statewide regulation on intermodal equipment.  This rule would seek to require new facilities or facilities subject to expansion to employ the cleanest available equipment at an earliest possible date to mitigate NOx and diesel PM emissions.

Port Facility Control Measures

Staff may proposed a series of rules under Regulation XXXX: 1) New and Expanded Sources – The proposed rule(s) would require the use of best available control technologoies or maximum feasible controls for reducing criteria (i.e., NOx and PM10) and toxic pollutants and to offset or mitigate residual emissions to the extent feasibile at terminals, railyards and other port-related facilities; 2) Health Risk Assessment – The proposed rule(s) would require health risk assessments at new, expanded, or existing terminals, railyards, and other port-related facilities similar to R3503 – Emissions Inventory and Health Risk Assessment for Railroads; and 3) Risk Reduction – The proposed rule(s) would require reductions in air toxics and criteria pollutants and/or the application of best available controls; 4) Other measures to backstop port actions to reach air quality or emission reduction goals may be adopted as necessary to assure timely attainment of such goals.
