SYNPOSIS:

The Stationary Source Committee met Wednesday, December 21, 2005. Following is a summary of that meeting. The next meeting will be January 27, at 10:30 a.m., in Conference Room CC8.

Attendance
The meeting began at 10:30 a.m. Present were Dr. Burke (attended by videoteleconfer-ence), Dennis Yates, Acting Chair (appointed by Dr. Burke), Jane Carney and Gary Ovitt. Absent was Ronald Loveridge.

INFORMATIONAL ITEMS

1. Final Annual Status Report on Rule 1113 – Architectural Coatings
Lee Lockie, Director of Area Sources, summarized the 6th annual status report to the Board on architectural coatings. This report is scheduled for consideration at the January 2006 meeting of the Governing Board. She explained that this report focuses on progress toward achieving the July 2006 VOC limits contained in Rule 1113 and that a draft of the report was released for public comment in June of this year. Since that time, additional data has been received from recently completed laboratory testing performed under contract to the District.

She explained that staff’s approach to evaluating the availability and performance of the coatings designed to meet the July 2006 standards was to use many available sources of technical information. First, staff reviewed the results of laboratory and outdoor expo-sure performance studies conducted by various technical firms under contracts with the District since 1998 which compared performance characteristics of high and low VOC coatings. The results were consistent in their conclusions that the low VOC materials, with a few key exceptions, performed as well or better than their high VOC counter-parts. Second, staff used other sources of data and information including:

  1. CARB 2000 Architectural Coating Sales Survey;
  2. Field visits to coating manufacturers to review their readiness for the July 2006 limits and any technical obstacles or delays that they are encountering;
  3. On-Shelf Product Inventories;
  4. Random field visits to over 100 new construction sites where coatings are applied; and,
  5. Web-based Data Searches for information on available products that meet the July 2006 limits.

She also described the purpose of the Board Ad Hoc Committee established by Board Chairman, Dr. William Burke. The Ad Hoc Committee provides an open forum for discussion of alternatives to the current structure of Rule 1113. At the first meeting of the Ad Hoc Committee in July, the National Paints and Coatings Association offered to pro-pose a new structure for the rule that would achieve the same overall VOC emission reductions while providing the industry flexibility in meeting technology-forcing limits. NPCA submitted 3 proposals but staff determined that they increased emissions substan-tially and that they could not be accepted. Ms. Lockie then presented staff’s findings and a counter proposal for amendments to the rule that reduced VOC emissions and pro-vided flexibility to the industry in meeting some of the more challenging limits for 2006.

The report concluded by presenting staff’s findings and recommendations for amendments to Rule 1113.

The specific technical recommendations contained in the report are to: (1) establish a new category for non-flat high gloss coatings with an interim VOC limit of 150 g/l ef-fective on July 1, 2006 and a final limit of 50 g/l effective on July 1, 2007; (2) extend the final compliance date for quick dry enamels, by one year to July 1, 2007 and estab-lish an interim limit of 150 g/l for July 1, 2006; (3) tighten or accelerate VOC limits for several categories where low-VOC products are available; and (4) evaluate the partial delisting of tertiary butyl acetate (TBAc) for certain industrial maintenance coatings as part of the Rule 1113 rule development process, to allow more flexibility in reformula-tions.

She concluded by stating that a public workshop on the staff’s proposed amendments to Rule 1113 will be scheduled for January, 2006.

During the public comment period, Hal Dash of Cerrell Associates, read a letter from J. Andrew Doyle, President, National Paint and Coating Association expressing their con-cern relative to the short time allotted to review the final draft of the Rule 1113 annual report. Additionally, he discussed NPCA’s concern for the lack of a timely response to technical proposals submitted to AQMD staff. In response, Dr. Wallerstein commented that there were delays in receipt of certain laboratory data from the District’s testing contractor that was beyond our control due to the complexity of the testing. With re-spect to their technical proposals, he indicated that the NPCA failed to meet their own standard of being emissions neutral. Following Dr. Wallerstein’s response, Mr. Dash committed to submitting NPCA comments by the first week of January. Curt Coleman spoke on behalf of the Sherwin Williams Company expressing their concern relative to the timeframe for reformulation of industrial maintenance products.

WRITTEN REPORTS

Carol Coy stated that the dates on the Advance Calendar should all be 2006 rather than 2005.
