Emissions Inventory and Health Risk Assessment for Ports and Port-Related Facilities

As part of Regulation XXXX, proposed Rule 4010 is being moved from to-be-determined to September.  Proposed Rule 4010 will require ports and port related facilities to develop an emissions inventory and to develop a health risk assessment to quantify the cancer and non-cancer health risk from their facility.  Proposed Rule 4010 is a backstop rule that will be implemented if ports in the district do not provide adequate information on emissions inventory and health risk assessment in a timely manner.

New Source Review for Port and Port-Related Equipment

As part of Regulation XXXX, proposed Rule 4030 is being moved from to-be-determined to December 2006.  Proposed Rule 4030 will require any port or port-related facility in the district to use the Cleanest Available Equipment (CAE).  The proposed rule would apply to an existing port or facility that is expanding or a new facility whose equipment is emitting a criteria pollutant.  Proposed Rule 4030 is a backstop rule that will be implemented if ports in the district do not reduce emissions in a timely manner as needed for the 2007 AQMP.

Toxic New Source Review for Port and Port-Related Facility

As part of Regulation XXXX, proposed Rule 4035 is being moved from to-be-determined to December 2006.  Proposed Rule 4035 will require any port or port-related facility in the district to use the Cleanest Available Equipment for Toxics (T-CAE).  The proposed rule would apply to an existing port or facility that is expanding or a new facility whose equipment is emitting a toxic air contaminant.  Proposed Rule 4035 is a backstop rule that will be implemented if ports in the district do not decrease toxic emissions to reduce community exposure in a timely manner to a level specified by the proposed rule.
