PROPOSAL:

Issue Fleet Modernization Program Announcement for “Year 9” Carl Moyer Program and Adopt Resolution Recognizing Carl Moyer Program “Year 10” Funds

SYNOPSIS:

Pre-1990 heavy-duty diesel trucks are high-polluting vehicles that contribute significantly to the South Coast Air Basin’s NOx, PM10, and VOC emissions. Pre-1990 trucks can emit three times as much NOx and over 40 times as much particulates as trucks meeting the current on-road heavy-duty engine exhaust emissions standards. The Carl Moyer Program includes a heavy-duty on-road truck fleet modernization category under which incentive funds are provided to truck owners/operators to replace pre-1990 vehicles with newer, cleaner vehicles. This action is to: 1) issue a Program Announcement to solicit projects to replace pre-1990 diesel trucks with Model Year 2007 or newer diesel or natural gas-fueled trucks at a cost not to exceed $6 million based on the AQMD’s Fleet Modernization Plan approved by CARB; and 2) adopt a resolution recognizing Carl Moyer Program “Year 10” Funds. The Board has set aside $6 million from the Carl Moyer Program Fund SB 1107 Account for Fleet Modernization.

COMMITTEE:

Technology, March 21, 2008. Less than a quorum was present for the discussion of this item; the Chair communicated their concurrence and recommendation that this item be forwarded for Board consideration with no approval or disapproval recommendation from the Committee.

RECOMMENDED ACTIONS:

  1. Approve issuance of the Carl Moyer Fleet Modernization Program Announcement #PA2008-08 to solicit projects to replace pre-1990 heavy-duty diesel-fueled trucks with Model Year 2007 or newer diesel or natural gas trucks in an amount not to exceed $6 million from the “Year 9” Carl Moyer Program Fund SB 1107 Account.
  1. Adopt a Resolution recognizing and accepting the terms and conditions of the FY2007-08 (Year 10) Carl Moyer Grant Award in the amount of $34,782,473, which supersedes Resolution 08-1 and includes additional funding received in the amount of $299,530.

Background

In 2005, the heavy-duty on-road fleet modernization program category was added to the Carl Moyer Program. The Fleet Modernization Program provides financial incentives to replace pre-1990 high-polluting diesel trucks with newer and cleaner diesel or natural gas trucks. At its July 7, 2006 meeting, the Board approved allocation of the first $6 million for the Fleet Modernization Program. The AQMD has since funded replacement of approximately 78 pre-1990 trucks and expended $6,016,147. At its February 2, 2007 meeting, the Board set aside additional $6 million from the “Year 9” Carl Moyer Program Fund SB 1107 Account for the Fleet Modernization Program.

Proposal

Fleet Modernization Program Announcement
This action is to issue the attached Program Announcement to solicit projects under the Carl Moyer Fleet Modernization Program to replace pre-1990 heavy-duty diesel-fueled trucks with Model Year 2007 or newer diesel or natural gas trucks in an amount not to exceed $6 million based on the AQMD’s Fleet Modernization Plan approved by CARB. Fleets operating in targeted vocations (agricultural, construction, mining, and forestry) can receive funding for up to twenty trucks, and fleets operating in open vocation categories can receive funding for up to five trucks.

New Resolution for the Carl Moyer Program
The Board originally approved a resolution #08-01 at the February Board for $34,482,943. Since that time an additional $299,530 has been award to the AQMD for “Year 10” Carl Moyer Funds. A new Resolution must be adopted reflecting $34,782,473 as the correct amount of funding received.

Outreach

In accordance with AQMD’s Procurement Policy and Procedure, a public notice advertising the Program Announcement and inviting bids will be published in the Los Angeles Times, the Orange County Register, the San Bernardino Sun, and Riverside County Press Enterprise newspapers to leverage the most cost-effective method of outreach to the entire South Coast Basin.

Additionally, potential bidders may be notified utilizing AQMD’s own electronic listing of certified minority vendors. Notice of the Program Announcement will be mailed to the Black and Latino Legislative Caucuses and various minority chambers of commerce and business associations, and placed on the Internet at AQMD’s Web site (http://www.aqmd.gov where it can be viewed by making menu selections “Inside AQMD”/“Employment and Business Opportunities”/“Business Opportunities” or by going directly to http://www.aqmd.gov/rfp/index.html). Information is also available on AQMD’s bidder’s 24-hour telephone message line (909) 396-2724.

Benefits to AQMD

The successful completion of the fleet modernization project will significantly reduce NOx and PM10 emissions in a cost effective and expeditious manner.

Resource Impacts

The total project cost of $6 million for the Fleet Modernization Program will be provided from the “Year 9” Carl Moyer Program Fund, SB 1107 Account.

RESOLUTION NO. 08-

A Resolution of the South Coast Air Quality Management District Board
Recognizing and Accepting the Terms and Conditions of the
FY 2007-08 Carl Moyer Grant Award

WHEREAS, under Health & Safety Code §40400 et seq. the South Coast Air Quality Management District (AQMD) is the local agency with the primary responsibility for the development, implementation, monitoring and enforcement of air pollution control strategies, clean fuels programs and motor vehicle use reduction measures; and

WHEREAS, the AQMD is authorized by Health & Safety Code §§40402, 40440, and 40448.5 to implement programs to reduce transportation emissions, including programs to encourage the use of alternative fuels and low-emission vehicles; to develop and implement other strategies and measures to reduce air contaminants and achieve the state and federal air quality standards; and

WHEREAS, the Board has adopted several programs to reduce emissions from on-road and off-road vehicles, as well as emissions from other equipment, including the School Bus Incentive Program and the Carl Moyer Program; and

WHEREAS, the South Coast Air Quality Management District is designated as an extreme non-attainment area for ozone and as such is required to utilize all feasible means to meet national ambient air quality standards; and

WHEREAS, additional funding in the amount of $299, 530 was awarded to the South Coast Air Quality Management District’s Carl Moyer Program; and

WHEREAS, this resolution reflects the new funding received and supersedes Resolution 08-1 approved by the Governing Board at the February 1, 2008 Board hearing.

THEREFORE, BE IT RESOLVED that the Board of the South Coast Air Quality Management District, State of California, in regular session assembled on April 4, 2008, does hereby accept the terms and conditions of the 2007-08 (year 10) Carl Moyer Program grant award and recognizes up to $34,782,473 in SB 1107 funds.

BE IT FURTHER RESOLVED that the Executive Officer is authorized and directed to take all steps necessary to carry out this Resolution.
