The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD’s rulemaking and control measure implementation schedule. Scheduling changes that occurred since last month’s forecast are summarized.

222.1* Filing and Registration of Architectural Coatings
Rule 222.1 has been removed from the calendar and the provisions incorporated into Proposed Rule 314 – Architectural Coating Fees.
407.1 Carbon Monoxide Emissions from Permit Units
Proposed Rule 407.1 has been removed from the calendar and amendments to Rules 1302. 1303, 1701, 1702, and 1703 have been scheduled to address BACT requirements for attainment of air contaminants.
461 Gasoline Transfer and Dispensing
Rule 461 is moved forward to March from June to ensure timely implementation of the enhanced vapor recovery program requirements, provide needed clarity and improve enforceability.

These rules are added to the May calendar to harmonize the BACT requirements for attainment and non-attainment air contaminants for both New Source Review (NSR) and Prevention of Significant Deterioration (PSD). This rulemaking replaces that of Proposed Rule 407.1.

Reg. IV, IX, X, XI, XIV, and XX Rules Various rule amendments may be needed to meet the requirements of state and federal laws (e.g., SB 700), address variance issues/technology-forcing limits, or to seek additional reductions to meet the SIP short-term measure commitment. The Air Toxics Control Plan (ATCP) is being updated to include new measures to address toxic emissions in the basin. The revised ATCP will include a variety of measures that will reduce exposure to air toxics from stationary, mobile, and area sources.

Note: AQMD may add control measures necessary to satisfy federal requirements, to abate a substantial endangerment to public health or welfare, state regulatory requirements or SIP commitment.
