A Notice to Comply is an enforcement tool used by
AQMD inspectors to document:
Minor violations of AQMD rules.
Minor violations are violations that are administrative or procedural in
nature, or which involve a de minimis amount of emissions increases.
Rule 112 – Minor Violations
establishes uniform criteria for issuance of Notices to Comply for these kinds of
minor violations.
Minor violations that are corrected in the presence of the inspector
will not result in issuance of a Notice to Comply unless they are repeated minor
violations. In such cases, a
Notice of Violation
, which is a more serious enforcement action, could result in penalties.
Requests for information from a facility.
Information is defined as data, records,
photographs, analyses, plans, or specifications which will disclose the nature,
extent, quantity, or degree of air contaminants which are, or may be, discharged
by a source, or which are relevant to establish rule compliance. A person who timely
complies with a request for information issued through a Notice to Comply may not
have that count used to establish a chronic violation
or that person as a recalcitrant violator.
This database contains information about Notices to Comply issued on or after January
1, 2003, for minor violations ONLY.
